    Hey stop being negative. All we can do is hope n god willing we will get it. I have been waiting to get my green since last 12 years ok. Butr im still optimistic. Also lets fax the congress n whitehouse for the same. Ifu guys see numberusa site the anit immigrant pepole r pilling up the faxes against it so lets all unite n send the faxes in support of it. Also with the blue visas in Europen country will make a big difference for us. So they r quiet aware. Lets not fight and give reds to each other instead concentrate on faxing the faxes to white house in support of this bill as irt does matter all of us. United we stand and i bet u there r enough pepole like me n u waiting for the green.

    You probably didn't get my point.

    I am trying to distinguish between 'offering to cover' vs 'actually have covered'. There could be a lot of difference.

    I get your point. I have not used it so far. I figured if need arises and the insurance company refuses to pay then there are legal avenues to claim money from them.

    I've used CiTibank's Global wire transfer service (from my US CiTibank account to an Indian HSBC account) and they charge $30 for upto a few thousand dollars wired per transaction.

    As I understand it, CiTibank does not charge any money for wire transfers from the US to India, PROVIDED the transfer is between two CiTibank accounts. I have not tried this yet but am planning to set up a CiTibank account in India next time I'm home .. the $0 transaction fee seems worth it.

    I think each person can write their own story and here are a few writing points as appropriate.

    1) How long you have been here, and how despite your contributions in work and taxes, creativity(of jobs?) and maintainineg legal status, you have been left in a difficult spot of no permanency of status.

    2) How you have benefited from this country and would like to give back, and understood that to be the tradition on which america was built.

    3) If you have US born Children. That it would be unjust to ask them to be brought up elsewhere.

    4) That your entrepreneural ideas have been held back by your inability to have permanency of tenure here.

    5) That you never understood that to be the way it is done in America. However, a little voice keeps telling you to never quit on America, as she eventually gets it right.

    6) That you have been unable to buy a home due to this issue and wonder why it is that you can't help yourself while helping America. That you have a stable job, 20% down, excellent credit and the whole nine yards except the green card. That there are thousands like you waiting to jump in.

    7) How the US gov't bureaucracy has "wasted" over half a million green cards already allocated annually by congress, all happened while there were years long queues and merely recapturing those visas has been blocked by gridlock.

    8) Mention Immigrationvoice in your e mail, and state that we have some great ideas on how to make the EB system more efficient and would love to be engaged in improving the system.

    Come on, it's not you and me stood up, spent personal time, sacrificed so much.

    If you can not contribute for obvious reasons, no one is demanding you. I hope and sincerely wish that 'Aman' doesn't have to sell his house.

    Was it the first extension (before the completion of 6 years)?

    140 was approved and filed 485, moved on to EAD right after first H1 expired (6yrs). Worked on EAD for 2.5 yrs and then had to move back to H1( did not even know we could :D ) due to some personal issues. So applied for extension and got approved for 3 yrs.

    dont know if i got lucky or if there exists some condition here. I am not sure if it was treated as a new H1 or an extension but I guess the paperwork submitted quoted it as an extension based on 140 approval and a pending 485.

    I also got email from CRIS last night stating that my I-129 has been reopened.

    I have a very simple immigration history:

    I-129 filed and approved April 2005, petition expires 3/30/2008; only ever worked for this same company.

    No H-1B extensions ever filed, no H-1B transfers ever done, no previous history of US immigration prior to April 2005.

    Labor, I-140 and I-485 were filed November 2006; I-140 approved February 2007, I-485 approved June 2007, EB2 green card arrived June 2007.

    There was a LUD on the I-140, in August, but that was about the same time as a bunch of other people got LUDs on cases starting SRC07... seems like I can disregard that.

    There was also a LUD on the I-129 without a status change later in August. No explanation for that was apparent.

    And now I get a notice on 10/23/2007 saying that the I-129 has been re-opened and that something will happen within the next 30 days. I'll be sure to keep you all updated if I get anything like an actual I-797 notice through the mail.

    Did anyone else get anything on October 23rd?
    why bother about I129 if you have a GC ?

    These consulting firms are really annoying. USCIS should try to close this loophole.
    Like I said, I did not catch the whole speech, but from what I heard, he was not talking completely against it, he mentioned that businesses need more H1B's and should be able to hire foreign talent.

    He was mainly against abuse by big consulting firms (he gave out a statistic that 20K of the H1B went for 8 or 9 of the top consulting firms or something like that).

    At least there is something happening..... we have only two weeks....... this may be our only chance this year to attach anything EB

    My PD is Nov 2004 (EB3 India). My 140 has not been approved yet. Also, I do not plan to use EAD so issues thereby are out of question. My only worry is can I keep renewing H1B while my 485 has not been approved. My attorney says NO. He says that you can apply for H1B extensions after 6 years only if you have not been able to apply for 485.

    However based on your responses, it looks like I will have to validate this with some other lawyer to make sure if I can keep extending my H1B so I can maintain my wife's H4 status.

    From what I know your lawyer is wrong, you will get one year H1 extensions in your case.
    ask another lawyer or go over older Murthy chatlogs/faqs.

    That seems to be the way where this is heading. Would this be another july fiasco?.
    I dont mean to sound negative but I desperately need a way to file I-485 for my wife to get EAD. She has been rejected twice just coz she did not have a work permit/or was not a GC holder/citizen.
    Mind you she has a brilliant engineering academic record and worked in India for 2 years a Java programmer before marrying me :mad:
    I don't know if USCIS has "wasted" visa numbers but just like the Government has been "borrowing" money from future why cant they borrow "visa numbers" from future (or even past for that matter)...does sound ridiculous :eek: The economy is in recession for last 2 years for sure. Less and less number of folks are filing for GC. I would expect the EB1 numbers spilling over big time to EB2. That has not happened. Its been 3 loooong years after the July 07 fiasco and USCIS still doesnt have enough numbers to clear the backlog...this is BS.
    Bottomline is we do need USCIS to advance the dates rapidly enough so that thousands like me can be relieved of their daily ordeal in US....sorry for the selfish thought..:o I just had a shot of tequila....

    This fellow who wrote this might be one of those arm chair critics who just criticizes everything if it doesn't favor that individual. What a moron. I am sure this fellow is clueless about how much effort is put into to make a legislation.

    There has been lot of work done by many IV volunteers just to get a bill introduced. It is so stupid just to trash talk the efforts put in by the selfless IV volunteers.

    All IV members has to be proud that we have been able to get a bill that addresses the GC backlogs. Hey one year back lawmakers were clueless about EB GC issues. Now majority of the lawmakers atleast have an understanding about EB GC issues. It is a matter of time before we succeed.

    The easiest guage for the success of the IV efforts is to see the response U get from the lawmakers when U write to them about GC issues. Earlier U used to get a generic reply about undocumented workers and broken borders, nowadays U would be getting replies that talk about EB immigration. Isn't that an achievement. As a professional aren't U proud that U are give the respect U deserve rather than getting clubbed with undocumented workers. Ask for U'r self?


    I agree that person is somewhat misinformed in what it takes to get a legislation passed. No doubt there are so many IV members who have put in hours and hours of selfless work to get things moved. They deserve unreserved accolade for that.

    And, for the record, there have been various bills (that eventually ended up in the dustbin) even before IV. IVs major contribution is in decoupling the legal and illegal immigration bills (which again were disengaged in many previous bills, till someone decided that they need to add illegal immigrant provisions to it).

    USA has a right to choose who they give green card to but not fool Indian people by swinging visa bulletin by 4 years every now and then. Not by discriminating. There should be some transparency to the process and law should be followed. If USA makes a law that Indians wont get GC in EB, I am happy to note. Can they remove their gloves?

    I agree at fullest. Standing in line is one thing, and watching like a fool while others jump ahead of you is another. What is more disturbing is the law allowing this jumping process, and doing nothing about it.
    Mr. seen it all who started this thread hasnt seen much, or he/she would be different on the opinion of getting a life.

    I am married too, but i only said that there are other easier paths aswell.

    Regarding working late, i am a fulltime employee with H1-B and never came to office before 10:00AM and stayed after 6:00PM and never ever worked weekends. Mine can be an exceptional case, but what iam saying is, your relationship with your manager is important. This can make a lot of difference in your lives.
    As long as you deliver what is expected of you, you can even work 4 days a week and get paid for 40 hrs per week.

    I don't know, if we are deviating from our main discussion agenda started by LogicLife.

    I am sorry srikondoji but i have to disagree on some points.


    Yes you can do that. But you work late coz people Not dependant on H1B's can leave on their scheduled times coz if they get laid off, they wont be deported if they dont get a job in 10 days. Sure there is No Formal distinction on paper between H1B's and Non H1Bs, but it is assumed that since ur application depends on the employer (entirely), you will put urself to the grind.


    What about people who come here already married? Now for those unmarried you have to marry a Citizen to get a Green card. Marriage is a totally seperate thing and is not something that should be used solely for getting a GC (IMHO). Sorry but i do not agree that marrying a citizen is an easier way of doing ur immigration.

    Employment based immigration is a very small part of legal immigration.

    Here is a break down of legal immigration #s for 2006 according to Yearbook of Immigration Statistics, published by Department of Homeland Security's (DHS) Office of Immigration Statistics (OIS) (available at Spotlight on Legal Immigration to the United States (http://www.migrationinformation.org/USfocus/display.cfm?id=651) By Gretchen Reinemeyer and Jeanne Batalova | Migration Policy Institute, November 2007).

    1,266,264 immigrants were granted legal residence in 2006.

    159,081 immigrants who received green cards through sponsorship from their US employers accounted for 12.6% of all legal permanent residents.

    However, 87,702 (or 55.1%) of the employment-sponsored immigrants were spouses and children of principal applicants.

    The share of employment-preference immigrants has varied between 3.3 percent (59,525) in 1991 and 22 percent (246,878) in 2005.

    The other categories are family preference (802,712), refugee + asylee (216,454), Immigration Reform and Control Act (IRCA) of 1986 + parolees (43,546) and Diversity Lottery (44,471).

    Employment based immigration is legal. However, it may help to add legal to the title.

    Employment based immigration is skilled. I think employment based immigration includes cooks, priests, .... They consider themselves to be skilled just like everyone else!

    If you just ask for improving legal immigration, they will improve family based or asylum.

    As some persons learnt yesterday, legal immigration has very low priority as compared to undocumented. Similarly, employment based immigration has no priority in legal immigration!
