    IMO standalone bills like these have little chance of passing. This is just a placeholder so that its text can be used in the CIR. Such bills are used to gauge the public reaction and the senates direction on the issue. The bill needs a companion bill from the house which will be difficult considering the composition of the house. In the coming months you will see many immigration related bills being introduced. We can always hope and write a letter to the senators about this bill, it has a better chance if there are more co sponsors.

    As prof Wadhwa mentioned the best option for us is to write to the lawmakers outlining our issue, education is the key. i write to my senators and congressman every 3-4 months (no email). You will always get a reply to your letter, sometimes the reply is not relevant to the issue you have mentioned:rolleyes: but every bit helps...I hope each member writes a letter, numbers generally make an impact.

    I am still debating whether to call in or to write - but I will definitely do one of the two. I just read the other thread linked to by 'internet' above & thought I would say a couple of things to the losers at alipac who worship racists like tancredo and lou: Don't distort this thread's message - we not are trying to gag Mr.Lou however much I puke everytime I see him spewing venow on 'aliens' -and I sometimes even admire his constant state of outrage and complete lack of shame. He and his worshippers at alipac are a reminder that bigotry may have been outlawed offcially in the 60's but definitely wasn't completely eliminated for posterity -a lesson to all those who forget history and think we have always been 'civilized'; we are the nation we are today because of the tireless work of so many great leaders supported by so many forward thinking Americans of all colors -so lets be clear - we WANT LOU to spew his venom and unvarnished bigotry in Detroit - we WANT alipac to worship such hatemongers so when youngsters wonder how people could have been done horrible acts in the past we can point to you guys and say 'here you go - now know that every generation has its bigots and its the duty of decent folks to oppose them - its a constant never ending fight!'

    After we reported this news, we learned that there were some readers who gravely misunderstood the "final" rule making process. They were confused with the "proposed" rule making process. In the final rule making process, there is no comment period before the rule takes effect. On the date when the final rule is published in the federal register, it becomes a binding rule and the rule-making process is complete. Certain provisions in the final rule may take effect on certain specific later date or dates, but the rule itself becomes a binding law on the date of publication of the rule in the federal register. Accordingly, unless the DOL changed the proposed rule, substitution of the beneficiary of the labor certification will be eliminated on the date of publication which includes the substitution of the beneficiary in the pending labor certification by amendment as well as the substitution of the beneficiary in the approved labor certification. For those who filed the substitution I-140 petition, the proposed rule provided that only "substitution approved" on the date of publication of the rule would survive. Substitution approved can be interpreted to mean approval of the substitution I-140 petition. For the 45-day validity of the certified labor certification, under the proposed rule, the certified labor certification on the date of publication was supposed to have 45 days to file the I-140 petitions. For the labor certifications which are approved after publication of the final rule must file the I-140 petitions within 45 days from the date of certification.
    The DOL could have changed part of the proposed rules in the final rule and the readers are cautioned to wait for the release of the final rule before they jump into any conclusion and take a misguided action.


    1. I was wondering how this rule would affect people like me. My labor has been approved and its been about 50 days. I will be applying for I-140 this week. Will this 45-day rule affect me?

    2. If what is stated in immigrationportal about the labor substitution is true, then we don't have any real benefit from the this rule, because all labors certified before the implementation of this rule are not bound by the 45-days time constraint?!? All the so called desi companies may not sell the labors, but would not spend money to cancel it either. So those old labors are going waste as they are still active.

    I would understand if walking_dude was asking me to fly to Michigan and stand with a placard in front of the radio station (which I MIGHT do btw), but sending an email is a five-minute effort, which everyone can do sitting at their home/office/library.

    a) Most banks have wiring fee ( $45)

    b) You must fill up a wire application every time.

    c) The bank which waived Wire Fee (suppose BOA ) sometimes convert $$ to Foreign currency right here at US,there by drastically reducing the Exchange Rate (once again they are private banks - we can't dictate their exchange rates)

    I joked with the BOA manager when he was trying to rip me off that way and asked him frankly whats the workaround - he told me to do a domestic USD wire to SBI-NY and instruct them to carry USD all the way to Foreign country (via International Wire) and then convert using SBI-India exchange rate which is fantastic.

    Who will do all that or lose money? These are the days for ONLINE-ACH man - Free transfer by mouse !

    Why don't you all just wire the money?
    Some banks waive its fees if you have a premium account with them.

    That seems to be the way where this is heading. Would this be another july fiasco?.
    I dont mean to sound negative but I desperately need a way to file I-485 for my wife to get EAD. She has been rejected twice just coz she did not have a work permit/or was not a GC holder/citizen.
    Mind you she has a brilliant engineering academic record and worked in India for 2 years a Java programmer before marrying me :mad:
    I don't know if USCIS has "wasted" visa numbers but just like the Government has been "borrowing" money from future why cant they borrow "visa numbers" from future (or even past for that matter)...does sound ridiculous :eek: The economy is in recession for last 2 years for sure. Less and less number of folks are filing for GC. I would expect the EB1 numbers spilling over big time to EB2. That has not happened. Its been 3 loooong years after the July 07 fiasco and USCIS still doesnt have enough numbers to clear the backlog...this is BS.
    Bottomline is we do need USCIS to advance the dates rapidly enough so that thousands like me can be relieved of their daily ordeal in US....sorry for the selfish thought..:o I just had a shot of tequila....

    almost 1735 days away from N400.the form looks very long. is there again a long line for it?
    My wait time is as long as yours, so I am not thinking about getting ready for citizenship just yet (lot can happen in 5 years). If the USCIS processing times are to be believed, they are supposed to take between 12 and 15 months to decide on a currently filed application (the server seems to be down now, so couldn't verify the latest status). There may be additional time differences depending on where you are located. And knowing how USCIS operates, backlogs are not unheard of (http://www.immigrationpolicy.org/images/File/factcheck/CitizenshipDayFactSheet09-16-08.pdf).

    Here is a comforting thought - and someone correct me if I am wrong - but unlike the hectic GC process with all the "inequalities" among various EB categories, naturalization process is a level-playing field where your specific skills do not matter. Everyone is considered equal here, whether you have got your GC via EB, FB or even amnesty route. This makes sense too, considering that your value (to this country) as a citizen rests primarily in your voting right, and someone who can cook is just as good to vote as another who writes smart computer codes (no knock on the cook, my wife is a fantastic cook herself). This is why the "priority date" for your citizenship application is set at 5 years (of continuous residency) from the date printed on your PR card, irrespective of your GC category (the wait is 3 years for those with USC spouse). The only condition that permits some arbitrariness in the evaluation process is in establishing a "good moral character", which makes point #6 in my original list important.

    There's a book put out by three 'scholars' from the Manhattan Institute with an innocuous title and everything else inside it anything but! The debate is being pushed to dangerous new grounds - while many openly say that all of America's immigration problems began in the 60's, code for colored people allowed in legally, one author said it was 'wrong' to link opening up immigration to all races (by abolishing hemispherical quota) and the civil-rights movement. Ofcourse he didn't say why. They always have to make a big point about Kennedy predicting that immigration wouldn't surge with the 60's act but why the 'surge' is a bad thing in itself is never fully explained - making use of hazy data and cause and effects that are highly diffuse to be really a true 'cause/effect' is the scholarly methodology used.And ofcourse he also argued that previous waves of immigration are different from the current ones but when the argument is brought up that immigrants eventually assimilate suddenly history is no guidance - in other words don’t look at history now! Given the complete lack of spine or commonsense of IV browsers, one can only hope this is just an ugly cycle that plays itself out and decent people recover their sensibility

    What i think is add this in your short term goal:

    In case we need to go back we should have atleast a flat (completely owned) to live and work.

    Paskal, You are right - I do not understand. But mostly I cannot understand because as an organisation - you do not explain. Frankly, all I can do is register my disappointment at both your response and your attitude.While I get it that IV is actively involved in doing things over the years aimed at resolving this issue, I might feel that I could respect and maybe even understand these efforts better if IV kept its website up to date and all members who sign in updated on what's happening.

    I have often seen threads on this site that have members complaining that IV is not doing anything - to which invariably the response is that one should join the donor forum. On the other hand we get newsletters from admin that ask up to tighten our belts etc. - and get more involved. Well, that cannot happen unless IV provides more updated information on what IV is actually doing, veiled references to behind the scenes activity and years of hard work are not enough to involve all those who have signed up here to become 'more involved'.

    As for this discussion going nowhere I could not agree more - you see to have an open discussion or indeed debate - there must be at least 2 willing participants. And since you have already decided that you do not have time for the Qs of a mere non-paying member of this forum, I do not expect any better.

    By the way, the way ahead is not to close doors, but to welcome questions and encourge those on this forum with curiosity to be more active. More often than not, I have seen that those who Q on this forum, are mocked, ignored, and treated as if they are wasting CORE's time. Sad for a forum that hopes to involve a wider audience in this issue.

    As a new user, I would try to understand what IV stands for, What political forces IV is against and have some political wisdom before I start asking IV to disclose everything in a public forum. There are valid reasons why IV is not revealing everything in a public forum. If you are interested in resolving your own GC issues and that of others on this forum, you should not ask IV to disclose all the strategies and thoughts in a public form.

    There are many IV members who are old members of IV who trusts IV core leadership blindly even though we don't know IV strategies or thought process completely. One thing many of us can assure you is that IV core works with best of our interests in mind, they are a bunch of dedicated and smart people who understand how to plan our advocacy effort wisely.

    I would suggest you trust IV core leadership with their advice and directions as it is better for our own interests.
